Terms and Conditions of Service
Effective Date: October 2026 • Governing Law: Commonwealth of Pennsylvania (6 P.S. § 11 & Act 108 CDRA)
1. Scope of Agreement & Repair Authorization
These Terms and Conditions constitute a legally binding contract between the equipment owner ("Customer", "Client", or "You") and Tekcom Solutions LLC ("Tekcom Solutions", "Company", "We", or "Us"). By submitting equipment (including desktop computers, laptops, custom gaming rigs, workstations, logic boards, servers, and storage appliances) for intake, diagnostic triage, board-level soldering, component replacement, or custom assembly, you grant Tekcom Solutions explicit authorization to disassemble, bench-evaluate, run diagnostic stress routines, and inspect the equipment.
2. Bailment, Latent Defects & Stress Testing Risks
Tekcom Solutions adheres to professional ESD-safe, thermal-monitored lab standards. However, hardware checked into our facility often arrives in a compromised or failing operational state (e.g., fractured BGA solder traces, degraded silicon, failing power delivery VRMs, or electrolytic capacitor fatigue).
3. Mandatory Customer Backups & Absolute Data Disclaimer
Customer Responsibility: Flash storage (NVMe/SATA SSDs) and magnetic hard disk drives (HDDs) are inherently volatile and subject to spontaneous corruption under hardware distress. The Customer retains absolute responsibility for maintaining complete, independent off-site or cloud backups of all personal files, financial ledgers, family media, databases, and operating systems prior to intake.
Limitation of Liability: Under no legal theory (contract, tort, negligence, or strict liability) shall Tekcom Solutions or its technicians be liable for loss, erasure, corruption, or encryption of programs, databases, or operating data, nor for consequential or incidental business losses resulting from data loss.
4. Possessory Liens, Storage Fees, 30-Day Abandonment & Disposal
A. The Right to Withhold (Possessory Lien Under 6 P.S. § 11): Pursuant to Pennsylvania Commonwealth statute (6 P.S. § 11), any person or entity altering, repairing, or storing personal property at the request of the owner maintains an absolute legal possessory lien upon that property. Tekcom Solutions exercises its statutory right to retain physical custody of the customer's equipment until all outstanding labor charges, component invoices, diagnostic fees, and accrued storage costs are paid in full.
B. Contractual Superiority & Clear 30-Day Abandonment Timeline: Because Pennsylvania common law requires judicial execution to enforce unwritten possessory liens, this signed Agreement constitutes a legally binding contract that explicitly defines and governs property abandonment:
- Notification & 14-Day Grace Period: Upon completion of diagnostics, service order finalization, or notice of unrepairability, Tekcom Solutions logs multi-channel communication (SMS, email notification, telephone, and online tracker update). The Customer is granted a fourteen (14) calendar day grace period from the initial completion notice to pay and collect their hardware with zero storage assessment.
- Accrued Storage Fees: On the 15th calendar day following completion notification, storage fees will accrue at the rate of $5.00 per calendar day ($35.00 per week) to cover commercial vault space, insurance, and secure climate-controlled holding.
- Absolute Forfeiture at 30 Days: If equipment remains unpaid or uncollected for thirty (30) calendar days following the initial notice of completion or diagnostic debrief, ownership of the equipment is completely and irrevocably forfeited to Tekcom Solutions. Tekcom Solutions assumes full title to the hardware and maintains the absolute right to sell the equipment at private/public sale, harvest functional components for workshop inventory, or recycle the chassis to satisfy unpaid balances and accrued storage debts.
C. Pennsylvania E-Waste Compliance (Covered Device Recycling Act • Act 108 of 2010): In strict compliance with the Pennsylvania Covered Device Recycling Act (CDRA), electronic computing devices—including laptops, desktops, server chassis, monitors, and tablets—are legally banned from municipal Pennsylvania landfills. Tekcom Solutions will never dispose of abandoned computing hardware in standard commercial refuse. Worthless, non-functional, or unmarketable abandoned hardware is routed exclusively through certified R2/e-Stewards IT Asset Disposal (ITAD) recycling vendors.
D. Mandatory Data Obliteration on Forfeited Hardware: Prior to any secondary sale, parts harvesting, or certified CDRA e-waste recycling of abandoned hardware, Tekcom Solutions enforces strict data sanitization. Technicians will permanently destroy or sanitize all attached NVMe, SSD, and magnetic storage media utilizing DoD 5220.22-M (3-pass wipe) or NIST SP 800-88 cryptographic sanitization. Storage media that cannot be verified clean is removed and physically pulverized. No abandoned equipment will ever be sold, transferred, or scrapped with customer data intact.
- Digital Signature at Intake: Every service order requires verified electronic or ink signature acknowledging the 30-day timeline.
- Multi-Channel Timestamped Audit: Systematically logged SMS, email, and portal ticket timestamps establish verified completion notice.
- Certified Mail Ultimatum: On day 20 post-completion, a Certified Letter with Return Receipt Requested is dispatched providing one final 10-day notice prior to title forfeiture.
- Data Obliteration & Custody Closure: Immediate cryptographic or physical destruction of storage before hardware liquidation or CDRA recycling.
5. Software Licensing & Legal Compliance
The Customer warrants that they possess lawful, authentic licenses for all operating systems and proprietary software applications installed or requested to be provisioned. Tekcom Solutions enforces strict anti-piracy standards and will not bypass legitimate activation servers or install unlicensed cracked software.
6. Governing Jurisdiction & Severability
This Agreement is governed by the laws of the Commonwealth of Pennsylvania without regard to conflict of law principles. Any legal action arising from services rendered shall be filed in the Court of Common Pleas of Montour County, Pennsylvania. If any provision of this Agreement is deemed unenforceable by a court of competent jurisdiction, all remaining provisions shall remain in full force and effect.
